      • Married 19-Sep-1855 in Green Bay, lived as husband and wife since then except as herein stated
      • Ten children, five of whom are still living: Ellen Agnes Delany (age 20), James Henry Delany (18), Joseph Peter Delany (14), John Michael Delany (12), Mary Ann Delany (8).
      • Both have been residents of Brown County since marriage
      • Cruel and inhumane conduct for past three years (verbal abuse, threats on life, personal violence); On or about 08-Oct-1876 grasped her by the neck; refuses to provide clothing, food and medicine, forbidden merchants and tradesmen from visiting or providing goods and services
      • Refuses to address her, sit at the same table, or occupy the same room
      • Charges her with criminal intercourse and improper conduct
      • Told her in Feb 1878 that he had obtained a divorce from her, with papers in his pocket
      • Almost impossible to keep a female servant in the house because of his frequent attempts at criminal intercourse with them
      • She has been faithful and has not given provocation for such cruel treatment
      • Unsafe to live with him
      • Defendant is owner of a house in Fort Howard worth about $3500 plus $700 household goods
      • Defendant is owner of other real estate estimated to be at least $5000, and of personal property of at least $5000
      • Demands divorce, custody of children, alimony for her and children, defendant pay her attorneys’ fees
      08-Aug-1878 statement of Catie Bailey, alleging improper advance by James Delaney in Feb 1878 while employed to do housework, forcing her to leave employment.

      09-Aug-1878 statement of Mrs. Mary Crary, alleging similar improper advances while employed as a servant (unmarried) in the fall of 1871.

      09-Aug-1878 statement of Annie M Delaney. A restatement of miserable circumstances, no money to pay attorneys’ fees, threatened with James taking away her youngest daughter Mary Ann.

      09-Aug-1878 Judge’s Order, with amendment 05-Sep-1878: order of protection, pay $50 toward attorneys’ fees, pay defendant $10/week until court action completed, not sell any real property, household goods or piano until court action completed.
